These General Conditions are for the purchase of products and services, carried out remotely via the internet on the website 'gponline.it', belonging to Gp Srl, V.le De Gasperi 35/3736061 - Bassano del grappa (VI) - P.I 04434210243

GENERAL CONDITIONS
1. The contract concluded between GP Srl and the Customer shall be deemed to have been concluded with the acceptance, even only partial, of the order by GP Srl. Such acceptance shall be deemed tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, you declare that you have read all the information provided during the purchase process, and to accept fully the general conditions and payment as described below.
2. If the Customer is a consumer (i.e., a natural person who purchases goods for purposes not related to his business), once the online purchase process has been completed, will print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of art. 3 and 4 of Dlgs 185/1999 on distance selling.
3. The Customer’s right to compensation or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or things caused by the non-acceptance or partial execution of an order.

 

HOW TO BUY
1. The Customer can order only the products in the electronic catalog at the time of placing the order and available online at gponline.it, as described in the relevant information sheets. It is understood that the image accompanying the product description may not be perfectly representative of its characteristics but differ in colour, size and accessories.

2. The correct receipt of the order is confirmed by 'gponline.it' by means of an e-mail reply, sent to the e-mail address communicated by the Customer. The reply is generated automatically by the system and cannot be considered as an acceptance of the order, but only confirmation of receipt. This confirmation message will contain the order execution date and time ('Order Date') and a 'Shopping Cart', to be used in any further communication with 'sgponline.it'. The message contains all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, according to the procedures described in this document.

 

PAYMENT METHODS
Depending on the type of payment, additional costs may apply, they will always be clearly indicated during the choice of the same mode, the processing of the electronic cart and in the order confirmation email.

1. Credit card. In the case of purchase of goods with payment method Credit Card, at the same time as concluding the online transaction, the credit institution will authorize only the commitment of the amount related to the purchase made. In case of cancellation of the order, both by the Customer and in the event of non-acceptance of the same by GP Srl, will be requested at the same time by GP Srl the cancellation of the transaction and refund of the amount paid. The repayment time depends exclusively on the banking system and the credit institution of reference and can reach their natural maturity. Once the transaction has been cancelled, in no case GP Srl can be held responsible for any damage, direct or indirect, caused by delay in the repayment of the committed amount by the banking system and the reference credit institution. GP Srl reserves the right to request additional information from the Customer (e.g. a landline phone number) or copies of documents proving ownership of the Card used. In the absence of the required documentation, GP Srl reserves the right not to accept the order. For the greater guarantee and security of the customer, at no time during the purchase process GP Srl is able to know the information related to the credit card of the buyer, transmitted via a secure connection directly to the website of the credit institution that manages the transaction. No computer archive of GP Srl will store such data. In no case GP Srl can be held responsible for any fraudulent and improper use of credit cards by third parties, when paying for products purchased on 'gponline.it'.

 

UNAVAILABILITY OF PRODUCTS


In case of non-execution of the purchase order by GP Srl due to unavailability, even temporary, of the requested PRODUCT, the staff, within 30 days from receipt of the order, will inform the CUSTOMER via e-mailmail of the cancellation of the order and will provide free, as soon as we receive the bank details of the CUSTOMER, to refund the price already paid for the purchase of the products no longer available. The unavailability of one or more of the PRODUCTS ordered will not give the CUSTOMER the right to cancel the entire order.

 

DELIVERY METHODS AND COSTS
1. The site gponline.it can receive orders with delivery in Italian and international territory. After registration, delivery costs calculated according to the country indicated will be shown.

2. No liability can be attributed to GP Srl in case of delay in the execution of the order or delivery of what ordered.

3. Unless explicitly indicated by our Customer Service, delivery is understood to be street level. When the goods are delivered by the courier, the Customer is obliged to check:
the number of packages delivered corresponds to what is indicated in the advance transport document by e-mail;
that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials (adhesive tape or plastic straps).
Any damage to the packaging and/or product or mismatch of the number of packages or indications, must be immediately disputed, by affixing the word "ACCEPTED WITH RESERVATION" on the courier delivery receipt. Once the courier document is signed, the Customer cannot object to any external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days after delivery, in accordance with the procedures provided for in this document.

4. In the event of failure to collect within 5 working days the material in stock at the courier’s warehouses due to repeated impossibility of delivery to the address indicated by the Customer when ordering, the order will be automatically canceled.

Important! During the holiday periods (Christmas, New Year and Easter), deliveries may be delayed and the times indicated for transport are purely indicative. In addition, during these periods, the days on which the last shipments will be made will be communicated by means of notices.

ORDER PROCESSING
Orders are processed 2- 7 days later (excluding Saturday, Sunday and holidays in general) from the acceptance of the order that arrives in real time to the customer via email.

INVOICING
For the Billing, the data must be communicated at the time of the order as per art. 22 D.P.R. 633 IVA, specifying the number of the Tax Code and the VAT number of the applicant. In any case please remember to provide a telephone number for any communication from us regarding your order.

SALES PRICES
The published prices include VAT, excluding shipping and payment costs and may be subject to change at any time without notice. It is understood that the price fixed at the time of purchase may not be changed. The articles on this site may also undergo technical modifications made by the Manufacturers for a technological improvement.

 

CONSUMER PROTECTION
Pursuant to Legislative Decree 206/05, if the customer is a consumer (that is, a natural person who purchases goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to GP Srl a reference of VAT), has the right to withdraw from the purchase contract, if it was concluded and concluded at a distance, for any reason, without having to provide explanations and without penalty, subject to the following conditions:
- the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal on only part of the product purchased (e.g.: accessories, software attachments, etc...);
- the right does not apply to sealed audiovisual products or computer software (including those attached to hardware), once opened;
- the right of withdrawal does not apply to custom-made or customized goods, such as personal computers with configuration chosen by the customer;
- the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc...); to limit damage to the original packaging, We recommend, whenever possible, that it be placed in a second box; the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided in all cases;
- According to the law, the shipping costs related to the return of the goods are borne by the customer;
- the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
- in case of damage to the goods during transport, GP Srl will inform the customer of the incident, to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, simultaneously cancelling the request for withdrawal;
- GP Srl is not responsible in any way for damage or theft/ loss of goods returned with uninsured shipments;
- Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the original packaging and/or packing is damaged, GP Srl will deduct a percentage from the refund due, however not exceeding 20% of the same, as a contribution to the restoration costs.

To exercise the right of withdrawal, the Customer must send GP Srl a communication in this regard within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgement of receipt, addressed to GP Srl with headquarters at Via Meucci, 115 - 36028 - Rossano Veneto (VI) or by telegram or fax sent within the aforementioned 10 days and followed by a confirmation letter with acknowledgement of receipt, sent DEFINITELY within 48 hours. Without prejudice to any repair costs for damage to the original packaging, GP Srl will reimburse the customer the entire amount already paid, within 30 days of the return of the goods, by means of a procedure for the reversal of the amount charged to the Credit Card or by bank transfer. In the latter case, it will be the customer’s responsibility to provide promptly the bank details on which to obtain the refund (IBAN code of the invoice holder). The right of withdrawal is totally lost, for lack of essential condition of integrity of the good (packaging and/ or its content), in cases where GP Srl determines:

- the lack of the outer packaging and/or the original inner packing;
- the absence of integral elements of the product (accessories, cables, manuals, parts,...);
- damage to the product due to causes other than its transport.

In the event of cancellation, GP Srl will return the goods purchased to the sender, charging him the shipping costs.

 

GUARANTEE
1. All products sold by GP Srl are covered by the manufacturer’s conventional warranty and the 24-month warranty for defects of conformity, pursuant to DL 24/02. To benefit from the warranty service, the Customer must keep the invoice or delivery note that will be sent by e-mail in electronic format PDF.


2. The manufacturer’s conventional warranty is provided in accordance with the procedures described in the documentation contained within the product packaging. If, following intervention by an Authorized Service Center, the defect should be not covered by the manufacturer’s conventional warranty, the Customer will be charged for any verification and restoration costs required by the Authorized Service.


3. The 24-month warranty according to DL 24/02 applies to a product that has a defect of conformity, provided that the product is used correctly, in accordance with its intended use and as provided in the technical documentation attached. This guarantee is reserved to the private consumer (natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference of VAT). In case of lack of conformity, GP Srl provides, without any expenses for the Customer, to restore the conformity of the product by repair/ replacement or reduction of price until the contract is terminated. If, following intervention by an Authorized Service Center, the defect should not be a lack of conformity according to DL 24/02, the Customer will be charged for any verification and restoration costs required by the Authorized Service, as well as the transport costs if incurred by GP Srl.

4. The replacements in case of DOA (Dead On Arrival: product not working at delivery) only take place if expressly provided by the manufacturer. The replacement or repair times of the product depend solely on the manufacturer’s policies.


5. If, for any reason, you are unable to return a product under warranty (restored or replaced) to your customer, GP Srl may proceed at its discretion to the full refund of the amount paid or to its replacement with a product of equal or higher characteristics.


6. No damage may be claimed to GP Srl for any delays in carrying out repairs or replacements.


7. In cases where the application of the guarantees provides for the return of the product, the good must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc...); to limit damage to the original packaging, we recommend, whenever possible, to insert it in a second box; should avoid in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product.

 

PRIVACY
The personal data requested during the order process are collected and processed in order to satisfy the express requests of the Customer and will not be transferred to third parties under any circumstances. GP Srl guarantees its customers compliance with the regulations on the processing of personal data, governed by the privacy code referred to in DL 196 of 30.06.03. APPLICABLE LAW
The sales contract between the Customer and GP Srl is concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the jurisdiction shall be that of the court of reference of his municipality of residence; in all other cases, The territorial competence is exclusively that of the Vicenza Court.

 

RIGHT OF WITHDRAWAL
Sales of products via the Internet are governed by law D.Lgs n. 21 of 21/02/2014 which regulates the subject matter of distance contracts, that is to say carried out outside business premises. The right of withdrawal may only apply to natural persons who purchase for purposes other than their own business.
The buyer can exercise the right of withdrawal within 14 calendar days from receipt of the goods and within the following 14 days must return the purchased good to the seller, receiving the refund of the purchase price within 14 days after exercising the consumer’s right of withdrawal.

 

HOW TO EXERCISE THE RIGHT OF WITHDRAWAL
1) Contact our Customer Service by e-mail at info@gponline.it and indicate your intention to use the right of withdrawal, citing the details of the purchase document.
2) Close the goods in their original packaging, which must be complete with all details and accessories supplied; pack carefully and indicate on the packaging, clearly visible, the order number.
3) Send the goods to the address indicated by our operators via mail. It is specified that the cost of shipping is borne by the sender.
4) Within 14 days of receipt of the returned goods, GP srl will credit the amount paid (net of shipping costs) exclusively to the customer registered as holder of the purchase order and with the same payment method used to make the purchase.
Warning: The return and refund of materials sent in conditions other than those indicated above will not be accepted.

 

CONDITIONS
To proceed with the return it is necessary that the products are in perfect condition, without any sign of use or assembly, with their original box and/ or bags, labels, instructions and everything that was included. They must therefore be in the same state as when they were purchased.
